1. Acceptance of Terms

By accessing and using Chartly's chart rendering service (the "Service"), you accept and agree to be bound by the terms and provision of this agreement.

If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Chartly provides an API service for rendering Chart.js configurations into image formats (PNG, SVG) with global edge caching. The Service includes:

• Chart rendering API endpoints
• API key management and authentication
• Usage analytics and billing dashboard
• API tool integration
• Technical documentation and support

3. User Accounts and Registration

3.1 Account Creation

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the confidentiality of your account credentials
• You must be at least 18 years old to create an account
• One person or entity may maintain only one account

3.2 API Keys

• API keys are unique to your account and must not be shared
• You are responsible for all activity associated with your API keys
• Report compromised API keys immediately
• We may revoke API keys for policy violations

4. Acceptable Use Policy

4.1 Permitted Uses

• Generate charts for legitimate business or personal use
• Integrate our Service into your applications and websites
• Cache rendered charts in accordance with our caching policies
• Use our API in applications and integrations

4.2 Prohibited Uses

• Attempting to reverse engineer or circumvent our Service
• Using the Service for illegal or harmful activities
• Generating excessive load or attempting DDoS attacks
• Sharing API keys or account credentials
• Creating charts containing illegal, harmful, or inappropriate content
• Reselling our Service without explicit permission
• Bypassing rate limits or usage restrictions

5. Service Plans and Billing

5.1 Plan Types

• Trial: Limited free usage to evaluate the Service
• Starter: Monthly subscription with defined usage limits
• Growth: Higher usage limits with advanced features
• Enterprise: Custom pricing and dedicated support

5.2 Billing Terms

• Billing is processed monthly in advance
• All prices are in GBP (British Pounds) unless otherwise specified
• Payment is due immediately upon billing
• Failed payments may result in service suspension
• Refunds are provided according to our refund policy

5.3 Usage Limits

• Each plan includes a specified number of chart renders per month
• Cached chart requests do not count against usage limits
• Overage charges may apply for usage beyond plan limits
• Rate limits are enforced to ensure fair usage

6. Intellectual Property

6.1 Our Rights

Chartly, its logo, and all related marks are trademarks of Maso Apps Ltd. The Service, including its software, design, and documentation, is protected by copyright and other intellectual property laws.

6.2 Your Content

• You retain ownership of charts and data you submit to our Service
• You grant us a limited license to process and cache your content
• You are responsible for ensuring you have rights to all submitted content
• We may remove content that violates these terms or applicable law

7. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

• We process data only as necessary to provide our Service
• Chart data is cached temporarily for performance optimization
• We implement industry-standard security measures
• You can request data deletion at any time

8. Service Availability and Support

8.1 Uptime

• We strive for 99.9% uptime but do not guarantee uninterrupted service
• Planned maintenance will be announced in advance when possible
• Enterprise customers may have separate SLA agreements

8.2 Support

• Email support is available for all paid plans
• Documentation and examples are provided at docs.chartly.dev
• Priority support is available for Growth and Enterprise plans
• We aim to respond to support requests within 24 hours

9. Disclaimers and Limitation of Liability

9.1 Service Disclaimer

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 Limitation of Liability

IN NO EVENT SHALL CHARTLY OR MASO APPS LTD BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Termination

10.1 Termination by You

• You may cancel your account at any time
• Cancellation takes effect at the end of your current billing period
• No refunds for partial months unless required by law

10.2 Termination by Us

• We may suspend or terminate accounts for terms violations
• We may discontinue the Service with 30 days' notice
• We may terminate accounts for non-payment
• Immediate termination may occur for serious violations

11. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting. Material changes will be communicated via email or service notifications.

Continued use of the Service after changes constitutes acceptance of the new terms.

12. Governing Law

These Terms of Service are governed by the laws of England and Wales. Any disputes will be resolved in the courts of England and Wales.
